Black-Owned CPT (“we”, “us”, “our”) provides a directory and community platform for discovering and supporting Black-owned and other POC-owned businesses in Cape Town, South Africa. The platform is operated by [your legal entity / trading name]. By creating an account, listing a business, or otherwise using the platform, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the platform.
2. Who can use the platform
You must be at least 18 years old to use the platform, because it includes nightlife, alcohol-related and social “mingling” features. By using it you confirm that you are 18 or older and able to enter into a binding agreement.
3. Your account
You are responsible for the information you provide and for keeping your login details secure.
You may not share your account, impersonate anyone, or create an account using false information.
You are responsible for activity that happens under your account.
Tell us promptly if you believe your account has been used without your permission.
4. Acceptable use
You agree not to:
Break any law, or use the platform to harass, threaten, defraud or harm others.
Post content that is unlawful, hateful, discriminatory, defamatory, obscene or misleading.
Post listings, events or reviews that are fake, spammy or not your own.
Attempt to access, disrupt or interfere with the platform, its security, or other users' data.
Scrape, copy or resell platform content or data without our permission.
5. Business listings
You may list a business only if you own it or are authorised to act for it, and you are responsible for the accuracy of the listing.
Our community focus is Black-owned businesses, and we also welcome other POC-owned businesses. We may ask for information to confirm eligibility.
You are responsible for the goods, services, hours, pricing and claims you publish.
We may review, edit, decline or remove a listing that breaches these terms or that we reasonably believe is inaccurate, misleading or harmful.
6. Events & ticketing
Businesses and hosts can post free or ticketed events. The host — not Black-Owned CPT — is the seller and is responsible for running the event and honouring tickets.
Ticket payments are processed by third-party South African payment processors (such as Payfast, Yoco or SnapScan) and paid out to the host, less applicable fees.
Refunds, cancellations and changes are set by the host. Please check the event details before buying. We are not responsible for an event that is cancelled, changed or not as described, though we will help where we reasonably can.
7. Community hosts & meetups
Community hosts organise meetups at partner venues. Hosts must run their meetups responsibly, lawfully and respectfully, and follow the venue's rules.
Host grades and features are based on verified guest ratings and may change or be removed at our discretion.
Partner venues confirm bookings before a meetup goes live and remain responsible for their own premises, licensing and safety.
We are not a party to the arrangement between hosts, guests and venues, and do not guarantee attendance, conduct or outcomes.
8. Vibe & check-in features
Vibe meters, crowd levels and the singles meter are for general guidance and entertainment only. They are based on anonymous, aggregated check-ins and may be inaccurate, delayed or incomplete. Do not rely on them for safety decisions or any important decision. They are never a representation about specific people present at a venue.
9. Your content & reviews
You keep ownership of the content you post (listings, photos, reviews, messages). You grant us a non-exclusive, royalty-free licence to host, display and promote it on and in connection with the platform.
You confirm you have the rights to everything you post and that it does not infringe anyone else's rights.
Reviews must be honest, based on genuine experience, and must not be defamatory. We may moderate, refuse or remove content that breaches these terms.
10. Payments & fees
Listing your business is free unless we state otherwise. Where the platform charges a fee (for example a platform fee on ticket sales), we will make it clear before you commit. Payment-processor fees are set by the processor. Payouts to hosts and businesses are made through the processor to the account they provide. You are responsible for your own taxes.
11. Intellectual property
The platform, its name, logo, design and software are owned by us or our licensors and are protected by law. You may not copy, modify or use them without permission, except for the content you yourself post.
12. Third-party services
The platform uses and links to third-party services (such as maps, fonts, social media and payment processors). We are not responsible for third-party services or websites, and your use of them is subject to their own terms.
Your safety matters. Black-Owned CPT helps you discover places, events and people, but we do not vet or guarantee any business, host, venue, event or individual. When meeting people, attending events or visiting venues, use your own judgement: meet in public, tell someone where you're going, look after your belongings, and arrange safe transport. You attend events and meet people at your own risk.
13. Disclaimers
The platform is provided “as is” and “as available”. To the maximum extent allowed by law, we make no warranties about the platform or about any business, listing, event, host, venue or user. We do not guarantee that the platform will be uninterrupted, error-free or secure, or that information on it is accurate or current. Nothing in these terms limits any rights you have under the Consumer Protection Act or other South African law that cannot lawfully be excluded.
14. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for loss arising from your use of (or inability to use) the platform, from dealings with businesses, hosts, venues or other users, or from events you attend. Where liability cannot be excluded, it is limited to the maximum extent the law allows. This does not exclude liability that cannot lawfully be excluded.
15. Indemnity
You agree to indemnify us against reasonable claims, losses and costs arising from your breach of these terms, your content, your listings or events, or your unlawful use of the platform, to the extent permitted by law.
16. Suspension & termination
You can stop using the platform and close your account at any time. We may suspend or end your access if you breach these terms, or to protect the platform or our users. Terms that by their nature should survive (such as content licences, disclaimers and liability limits) will continue to apply.
17. Governing law
These terms are governed by the laws of the Republic of South Africa, and you agree to the jurisdiction of the South African courts, without affecting any consumer rights you have under mandatory law.
18. Changes to these terms
We may update these terms from time to time. When we make material changes we will update the “last updated” date and, where appropriate, notify you. Continuing to use the platform after a change means you accept the updated terms.
